Terms of Service

Notice: PassPulse is an independent study-aid service. It is not affiliated with, endorsed by, or sponsored by the National Council of State Boards of Nursing (NCSBN®), which owns the NCLEX® trademark. PassPulse does not guarantee any specific exam outcome.

1. Acceptance of Terms

By accessing or using PassPulse (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

The Service is operated by PassPulse, a Wyoming company ("PassPulse," "we," "us," or "our"), located at Sheridan, Wyoming.

2. Description of Service

PassPulse provides a digital subscription service offering AI-powered adaptive NCLEX-RN examination preparation tools, including practice questions, performance analytics, mock exams, and an AI study assistant ("AI Tutor"). The Service is provided as a study aid only and is not a substitute for official NCSBN materials, nursing school instruction, or professional advice.

3. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you meet this requirement.

4. Account Registration

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at info@passpulse.pro if you suspect unauthorized access.

5. Subscription and Billing

5.1 Plans

PassPulse offers monthly, quarterly, and annual subscription plans. Pricing is displayed at the time of purchase.

5.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period. You authorize us to charge your payment method on file for each renewal.

5.3 First-Month Discount

New subscribers on the Monthly plan may be eligible for a discounted first month. The promotional price applies only to the first billing period; subsequent periods are billed at the standard rate.

5.4 Cancellation

You may cancel your subscription at any time from your Account page. Cancellation stops future billing. Your access continues until the end of the current paid billing period. No partial-period refunds are issued.

6. Refunds

Please see our Refund Policy for full details. In summary:

  • Subscription fees are non-refundable for the current billing period.
  • Cancellation takes effect at the end of the current period.
  • We do not offer prorated refunds for unused time.

7. Acceptable Use

You agree not to:

  • Share your account credentials or allow others to use your account
  • Scrape, copy, or distribute PassPulse content (including questions, rationales, or AI responses) without written permission
  • Use the Service for any unlawful purpose
  • Attempt to reverse-engineer or interfere with the Service

8. Intellectual Property

All content, questions, rationales, and materials within PassPulse are the exclusive property of PassPulse or its licensors. You are granted a limited, non-transferable license to access the Service for personal, non-commercial use during your active subscription.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

PassPulse does not warrant that:

  • The Service will be uninterrupted, error-free, or secure
  • Practice question content is error-free or current with the latest NCLEX Next Generation format
  • Use of the Service will result in passing the NCLEX exam

Your Readiness Score is a study-performance indicator only — it is not a prediction or guarantee of your actual NCLEX result.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PASSPULSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS OR EXAM FEES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Governing Law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Wyoming, USA.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
